§ 8.24.050. Prohibitions—Unlawful acts.

  • Except as provided herein, it is unlawful for any person to sell or display, offer to sell, give away, or use fireworks within the city without a permit. It is unlawful for a person to allow or permit fireworks to be used or exploded on his premises or premises under his control. It is unlawful for any person to mishandle or misuse fireworks. The following constitute unlawful mishandling or misuse of fireworks:

    A.

    It is unlawful to throw any fireworks, whether such fireworks is burning or not.

    B.

    It is unlawful to throw or to otherwise use fireworks from an automobile or other motor vehicle, whether the vehicle is moving or standing still.

    C.

    It is unlawful to store, keep, sell or use any fireworks within fifty (50) feet of any gasoline pump, gasoline filling station, gasoline bulk station or any building in which gasoline or volatile liquids are sold in quantities in excess of one gallon.

    D.

    It is unlawful to discharge or use any fireworks within one thousand (1,000) feet of any hospital, sanitarium or infirmary.

    E.

    It is unlawful to discharge or use any fireworks in, under or on an automobile or other motor vehicle, whether moving or standing still.

    F.

    It is unlawful to discharge or use fireworks within fifty (50) feet of any retail fireworks stand or facility where fireworks are sold.

    G.

    It is unlawful to mishandle or misuse fireworks in any other way.
