§ 8.08.150. Declarations of condemnation.

  • If the board finds such building or other structure is or had become a fire or health hazard or public nuisance, it shall by resolution:

    A.

    So declare; and

    B.

    Order such building or other structure condemned, abated, altered, repaired, removed or demolished; or make such other order or decision as will not be contrary to the public interest where, owing to special conditions, a literal enforcement of this chapter would result in unnecessary hardship, and so that the spirit of the provisions of this chapter shall be observed and substantial justice done;

    C.

    Provide that the owner of such building or other structure shall have at least thirty (30) days' time to remove such building or other structure ordered removed or demolished before the city proceeds to do so; and

    D.

    Provide for serving a copy of such resolution upon the owner of the objectionable building or other structure.
